Disney and James Cameron are trying to get a lawsuit thrown out, and it's messy.

An Indigenous actor filed a lawsuit saying Disney and Cameron used her likeness to create Neytiri. we all know Neytiri, she's basically the emotional core of the Avatar franchise. Zoe Saldaña plays her on screen, but the lawsuit claims the character's whole look drew from this other actor's likeness without credit or compensation.

So now Disney and Cameron filed a motion in a California federal court asking the judge to dismiss the whole thing. According to Reuters, the request was filed in a California federal court, but the actual legal arguments they're making haven't been laid out in the reporting yet.

so we don't really know their strategy here. What we do know is Neytiri is a fictional, computer-generated character, so presumably there's some argument to be made about whether a CGI alien counts as someone's likeness under the law. But that's straight up me guessing based on what the character is, not something confirmed in court filings.

The Avatar franchise is literally one of the most successful in movie history. Everyone knows this. So when there's a lawsuit about who contributed what to one of the central characters, people are gonna pay attention no matter how the legal stuff shakes out.

I keep thinking about what my grandma would say about this. She'd probably tell me the technology isn't the problem, it's how you treat the people behind it. Performance capture is this incredible tool that lets actors breathe life into characters that don't physically exist... but the humans powering that tech are real. Their faces, their expressions, their movement, like all of that feeds into what ends up on screen.

I'm not gonna pretend I know how this court case goes. Disney has literal armies of lawyers and they clearly think they have a path to getting this dismissed. We'll see if the judge agrees.

The court will decide whether this moves forward or gets tossed. Either way it's one to keep an eye on.
